Penalties for Theft Crimes in Maryland

Penalties depend on factors such as the value of the stolen property and whether the charge is a first offense. First-time offenses involving low-value property carry lighter penalties than repeat offenses or theft of high-value property.

Misdemeanor Theft

  • Property or services valued under $100: up to 90 days in jail & fines up to $500, plus restitution
  • Property valued between $100 and $1,500: first offense may result in up to six months in jail & fines of $500; repeat offenses can lead to up to one year in jail

Felony Theft

  • Property valued $1,500 to $25,000: up to five years in prison and $10,000 in fines
  • Property valued $25,000 to $100,000: up to 10 years in prison & fines up to $15,000
  • Property valued $100,000 or more: up to 20 years in prison & fines up to $25,000

Theft-related violent crimes carry even harsher penalties. Robbery can result in up to 15 years of incarceration, and armed robbery with a dangerous weapon can result in up to 20 years in prison.
